Terms of service
General Terms and Conditions (AGB)
1. Scope of Application
These General Terms and Conditions (hereinafter "GTC") of Kevin Schlieper (trading as "Wunder Maker"), Lissi-Kaeser-Str. 28, 80797 Munich, Germany (hereinafter "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods displayed by the Seller in his online shop.
2. Conclusion of Contract
2.1 The product descriptions in the online shop do not constitute binding offers on the part of the Seller, but serve for the submission of a binding offer by the Customer. 2.2 The Customer can submit the offer via the online order form integrated into the Seller's online shop. By clicking the button finalizing the order process (e.g., "Buy Now" or "Pay Now"), the Customer submits a legally binding contract offer. 2.3 The contract is concluded when the Seller accepts the Customer's offer within two days by:
-
Sending a written order confirmation or an order confirmation in text form (e-mail); or
-
Delivering the ordered goods to the Customer; or
-
Requesting payment from the Customer after placement of the order (e.g., via PayPal or Credit Card payment processing).
Special Note on Personalized Products: Since the products are manufactured individually according to customer specifications ("Print-on-Demand"), the production process typically begins immediately after payment confirmation.
3. Customer Specifications & Responsibility for Content
3.1 The Customer is responsible for providing correct and complete data required for the personalization of the products (e.g., names, text, selection of characters). 3.2 Preview & Approval: The Seller provides a preview function that allows the Customer to review the content before purchase. By concluding the contract, the Customer confirms that the data shown in the preview is correct. The Seller is not obligated to check the data provided by the Customer for spelling, grammar, or content correctness. 3.3 The Customer assures that the content provided by them does not violate the rights of third parties (in particular copyrights, trademark rights, or personal rights) or statutory regulations.
4. Prices and Terms of Payment
4.1 Unless otherwise stated, the prices quoted are total prices including the statutory value-added tax (VAT). Additional delivery and shipping costs will be specified separately in the respective product description and checkout page. 4.2 Payment can be made using the payment methods displayed in the online shop (e.g., Credit Card, PayPal, Apple Pay, Shop Pay).
5. Delivery and Shipping Conditions
5.1 Goods are delivered to the delivery address specified by the Customer. 5.2 If the delivery of the goods fails for reasons for which the Customer is responsible (e.g., incorrect address provided), the Customer shall bear the reasonable costs incurred by the Seller for the unsuccessful delivery attempt and potential return shipping.
6. Exclusion of the Right of Withdrawal
Important Notice: The statutory right of withdrawal (Widerrufsrecht) does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. Therefore, no right of withdrawal exists for the personalized books sold by Wunder Maker, as they are printed specifically for the Customer.
7. Retention of Title
The goods remain the property of the Seller until full payment has been made.
8. Liability for Defects (Warranty)
8.1 If the purchased item is defective (e.g., printing errors, production defects, damage in transit), the provisions of statutory liability for defects shall apply. 8.2 The Customer is asked to complain to the deliverer about delivered goods with obvious transport damage and to inform the Seller of this. If the Customer fails to do so, this shall have no effect on his statutory or contractual claims for defects. 8.3 Note on Color: Minor deviations in color between the screen display (RGB) and the printed product (CMYK) are technically unavoidable and do not constitute a defect.
9. Applicable Law
The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the laws on the international purchase of movable goods (CISG). For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
10. Alternative Dispute Resolution
The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr. The Seller is not obliged to participate in dispute settlement proceedings before a consumer arbitration board, but is generally willing to resolve issues directly with the customer.
